Seller guide

Montgomery County foreclosure resources and official contacts

Montgomery County publishes mortgage foreclosure diversion guidelines, updated October 2024, for certain residential mortgage complaints filed on or after October 16, 2024. Coverage depends on owner occupancy, debt amount and case type. Read the guidelines and your court order, call PHFA at 1-800-342-2397, and confirm sale details with the Sheriff or Tax Claim Bureau.

Who the guidelines cover

Owner-occupied homes with residential mortgage debt up to $500,000 in complaints filed on or after October 16, 2024. Some proceedings, including bankruptcy, estate and divorce matters, are excluded. A conference is typically scheduled several weeks after filing in covered cases.

Stays are conditional

Any pause in the case depends on a covered case and the court's order. Do not assume every case is stayed.

Sheriff versus Tax Claim

The Sheriff FAQ (2023) explains office roles; fees in it may be out of date. Confirm current details directly.

PHFA statewide help

PHFA's foreclosure/HEMAP line is 1-800-342-2397. HEMAP is a repayable loan with eligibility rules, and a late application does not stop a foreclosure.

Where WorkWithBar fits

We are private, not a counselor, court program or law firm. A property review is optional and separate from these resources, and our form does not pause any proceeding.

Before you call

Have the complaint, any court notices, your loan statements and income records ready. Note the date the complaint was filed, because the county guidelines turn on it. If you are unsure whether your case is covered, ask the court administrator's office or legal aid rather than guessing.
